Who we are 

The Medical Accidents Team is a specialist department at Marshall & Galpin, one of Oxford’s oldest firms of solicitors.  Each solicitor in the Team is an expert in medical negligence law and we have direct access to medical experts and a comprehensive medical library.
 

The Team have members on both the Law Society’s and AvMA’s specialist clinical negligence panels.  Action against Medical Accidents (AvMA) is an independent charity which supports people who have been affected by a medical accident.

We have offices in Oxford, Abingdon and Thame but act for people all over the world. 

What do we do?

The Team has vast experience of advising and assisting patients and families in coming to terms with the consequences of poor healthcare.  We obtain compensation to reflect suffering, reimburse financial losses and help fund much needed treatment, therapies, care and equipment.

We also recognise the concerns that many patients and families have about bringing these claims and that, often, compensation is not the primary aim.  We can help in trying to obtain an explanation for what has gone wrong and to bring mistakes to the attention of the people in charge so that, hopefully, other patients will not suffer in the same way.

The Team will guide you expertly through the various legal avenues available.  We have experience in dealing with all types of medical accidents, for all ages of patient and for the whole range of compensation awards; whether it is a few thousand pounds or a multi-million pound claim.

Our service does not stop with the award of compensation.  We work with you to ensure that your compensation does not affect your entitlement to any benefits you might be receiving.  We also assist in organising the carers, therapists, aids and equipment that can make all the difference.
 

What will it cost?

Our expertise and skill has been recognised by the award of a Legal Services Commission Franchise which means that we are one of the few remaining firms that can offer public funding (legal aid).

We can also offer a “no win, no fee, no cost” method of funding your claim (a Conditional Fee agreement) and regularly conduct cases using legal expenses insurance, where that is available.

Will bringing a claim affect my ongoing or future treatment?

In our experience the fact that a claim has been made very rarely affects the treatment patients are given.  If the treatment you are complaining about occurred in a hospital then usually the claim will be against the hospital or hospital trust and will not be against the individual concerned.  Invariably these claims are dealt with by Defence Unions, the NHS Litigation Authority or insurers so this is not something that should prevent you from making a claim.

Our philosophy

We try to make the legal process of making a claim as easy as possible for you.  The Team is committed to exploring alternative methods of resolving claims if that will assist you and have taken many cases to mediation.  Wherever possible we obtain interim payments from defence organisations and insurers to fund early rehabilitation therapy for injured patients. 

We have strong links with many support agencies and charities such as Headway, Scope and the Child Brain Injury Trust.
